SUMMARY OF OSBURN ORDINANCE NO. 302 A SUMMARY OF ORDINANCE NO. 302 AMENDING TITLE 6, OF THE OSBURN MUNICIPAL CODE, BY ADDING CHAPTER 6.13 REGARDING THE KEEPING OF DOMESTIC CHICKENS WITHIN THE CITY OF OSBURN, AND AMENDING CHAPTER 6.12.010 PERMITTING THE KEEPING OF CHICKENS WITHIN THE OSBURN CITY LIMITS, AND AMENDING CHAPTER 8.12.020 TO INCLUDE THAT THE KEEPING OF CHICKENS IS NOT A PUBLIC NUISANCE. THE ORDINANCE CONTAINS A NEW CHAPTER 6.13 WITH THE FOLLOWING SECTIONS: Section 01. Purpose. The keeping of domestic female chickens (hens) for a food source (egg and meat) is a beneficial activity to citizens. In perinitting citizens to keep chickens, the City of Osburn shall establish some limitations on keeping chickens to ensure the health and safety of the community. Section 02. Definitions. Sections 03 and 04. Limitations on the keeping of chickens and prohibits running at large. Sets the basic housing conditions for chickens within the city limits for the health, safety and welfare of citizens. Permits keeping up to six (6) chickens on one lot in any zone of the City of Osburn. Sets requirements for coops and runs to house chickens. Prohibits off premises chickens not contained at its owner or keepers premises. Section 05. Investigation and enforcement. Permits investigations and enforcement of possible violations and allows an enforcement officer to issue a notice of abatement or citation for violations. Permits enforcement officer to impound at large chickens, or confiscate adult male chickens/roosters. Section 06. Violation-penalties. Permits the city to issue municipal citations for violations or abaternent costs, so long as city code is followed for procedure and assessment of abatement costs. THE ORDINANCE AMENDS ORDINANCE 32, §1, AND TITLE 6, CHAPTER 6.12, SECTION 2 (6.12.020) TO: Exclude chickens as an unlawful aniinal to keep at any dwelling house within limits of the city. THE ORDINANCE AMENDS ORDINANCE 207, §2, AND TITLE 8, CHAPTER 8.12, SECTION 2 (8.12.020) TO: Exclude the keeping of chickens as a nuisance, so long as it is in compliance with chapter 6.13. Ordinance No. 302 provides for the addition to the Osburn City Code Chapter 6.13 which perinits the keeping of chickens within the City of Osburn and amendment of conflicting code on effective date of the Ordinance which effective date shall be upon publication of this Summary in one (1) edition of the Shoshone County News Press, a newspaper published in the City of Osburn, County of Shoshone, State of Idaho and having general circulation in the City of Osburn. This Summary was adopted for publication pursuant to Idaho Code, Section 50-901A and was passed and approved by the City Council of the City of Osburn, Idaho under a suspension rule upon which a roll call vote was duly taken by the City of Osburn, at a regular meeting of the City Council of the City of Osburn, at a regular meeting of the City of Osburn held on the 14th day of June 2022. The City attorney has filed a Statement with Ordinance Number 302 that this Summary is a true and complete Summary of Ordinance Number 302 and provides adequate notice to the public of the contents of Ordinance Number 302.
