NOTICE OF SHERIFF'S SALE NO. CV-2016-284 IN THE DISTRICT COURT FOR THE FIRST DISTRICT OF THE STATE OF IDAHO IN AND FOR THE COUNTY OF SHOSHONE BANK OF AMERICA, N.A., Plaintiff, v. LOWELL E. KRIEDEMAN; AND UNKNOWN PERSONS IN POSSESSION OR CLAIMING RIGHT TO POSSESSION, Defendants. NOTICE OF SHERIFF'S SALE NOTICE IS HEREBY GIVEN that on the 16th day of February, 2017 at the hour of 10:00 A.M., of said day in the Lobby of the Shoshone County Courthouse, 717 Bank St., Wallace, ID 83873, I will sell all of the right, title and interest of said Defendants, in and to the below described property, at public auction, to the highest bidder for cash in lawful currency of the United States, to satisfy said execution and all costs. The Sheriff, by Certificate of Sale, will transfer the right, title and interest of the judgment debtors in and to the property at the time the execution or attachment was levied. The Sheriff will give possession, but does not guarantee clear title nor continued possessory right to the purchaser. The judgment debtor or redemptioner may redeem the property from the purchaser within one (1) year after the sale, if the real property sold consisted of a tract of land of more than twenty (20) acres, and within six (6) months after the sale if the real property sold consisted of a tract of land of twenty (20) acres or less, paying the purchaser the amount of his purchase with interest thereon at the rate allowed in Section 28-22-104(1), Idaho Code, from the date of sale to the date of redemption, together with the amount of any assessment or taxes which the purchaser may have paid thereon after the commencement of the action and which are not included in the judgment, and interest at the rate allowed in Section 28-22-104(1), Idaho Code, on such amount. BY VIRTUE of an execution in my hands, issued out of the District Court of the First Judicial District Court of the State of Idaho, County of Shoshone, in the suit of BANK OF AMERICA, N.A. v. LOWELL E. KRIEDEMAN; AND UNKNOWN PERSONS IN POSSESSION OR CLAIMING RIGHT TO POSSESSION, Case No. CV-2016-284, duly attested the 5th day of January, 2017, I levied upon all right, title and interest of all defendants, in and to the following described real property, situated in Shoshone, County, Idaho, to wit: LOT 2, BLOCK 10, OF THE FIRST ADDITION TO SMELTERVILLE, COUNTY OF SHOSHONE, STATE OF IDAHO, ACCORDING TO THE OFFICIAL AND RECORDED PLAT THEREOF NOW INCLUDED IN AND FORMING A PART OF THE VILLAGE OF SMELTERVILLE, SUBJECT TO ALL EASEMENTS OF RECORD.
