Final Notice and Public Explanation of a Proposed Activity in a 100-Year Floodplain and Wetlands This is to give notice that the City of Mullan has conducted an evaluation as required by Executive Order 11988 Floodplain and 11990 Wetlands, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain and wetlands will have on the human environment. The Wastewater Collection System Upgrades project is funded in part by an Idaho Community Development Block Grant. The project scope of work includes the repair and replacement of key problem areas in the City of Mullan's original wastewater collection system over a 1-2-year period, will include upgrades of about 14,580 feet of mainline sewers, and replacement or rehabilitation of 103 manholes. Mullan has approximately 40 acres of FEMA mapped 100-year floodplain in its City Limits. The project's construction limits overlap 2 acres of the floodplain and 0.2 acres of wetlands. The proposed project is located in the City of Mullan. The City of Mullan has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: 1. (A) Adopt no alternatives and do not proceed with the proposed project: Mullan's sewer system is 100-years old and severely deteriorated. I/I throughout the system is contributing to an excess of wastewater at the South Fork Sewer District (SFSD) treatment facility that cannot completely pass through the treatment process resulting in discharge into the South Fork of the Coeur d'Alene River. High amounts of heavy metals in the wastewater from soil contamination also enter the sewer treatment facility and cannot be fully treated. This alternative is not practicable because it would leave the severely deteriorated system in its current condition and allow the I/I problems and heavy metal contamination to persist. The City has been issued a letter of noncompliance (dated 8/3/2018) from Idaho Department of Environmental Quality (IDEQ) due to these issues. (B) Determine which portions of the proposed project occur within the floodplain and wetlands and exclude them from construction repairs and replacement: This alternative is not financially or realistically feasible and does not address the serious problems within the City's wastewater collection system such as wide-spread areas of inflow and infiltration, seepage of untreated sewage into the South Fork of the Coeur d'Alene River, and heavy metal contamination. (C) Relocate the City's sewer system outside of the 100-year floodplain and wetlands: This alternative is not financially or realistically feasible for the City. The current sewer system cannot be removed and constructed in different location. (D) Continue with the current project plans and proceed with the proposed project within the 100-year floodplain and wetlands. The City of Mullan participates in the National Flood Insurance Program (NFIP), which makes it possible for Mullan citizens to qualify for FEMA flood insurance. The Idaho Department of Water Resources (IDWR) floodplain manager coordinates the National Flood Insurance Program and reviews city ordinances created to deal with floodplain problems and assists communities in adopting floodplain ordinances and qualifying them for the NFIP. The City of Mullan also follows Shoshone County's Hazard Mitigation Plan in the event of a flood. During construction, the contractor will be required to comply with IDEQ best management practices for storm water drainage. The project will maintain the natural and beneficial values inherent in the floodplain and wetlands. The City of Mullan has reevaluated the alternatives to building in the floodplain and wetlands and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and 11990 are available for public inspection, review, and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. This activity must be located in the floodplain and wetlands because no practical alternative is applicable. NOTIFICATION OF RIGHTS AND NOTICE OF COMPLIANCE For elementary and secondary schools - SY 2019/2020 In Accordance With the Family Rights and Privacy Act: as amended 1997 The Family Education Rights and Privacy Act (FERPA) afford parents and students over 18 years of age ("eligible students") certain rights with respect to the student's education records.
