Legal Notice STATE OF IDAHO LAND LEASE OPPORTUNITY PUBLIC AUCTION FOR LEASE Notice is hereby given pursuant to Article IX, § 8 of the Idaho Constitution and Idaho Code §§ 58-307, -310 and -313, that the State of Idaho, Department of Lands (hereinafter "IDL"), will conduct a public auction of Mineral Lease E310024, as set forth below. The deadline for auction registration is Tuesday, August 17, 2021, at 5:00PM (PDT). The live auction will begin on Tuesday, August 24, 2021, at 1:00PM (PDT) and will be held in the IDL Wolf Lodge Conference Room at 3284 W. Industrial Loop, Coeur d'Alene, Idaho. The lease will be awarded to the bidder who will pay the highest Premium Bid, as defined below. The Premium Bid payment is in addition to the annual rental payments, minimum annual royalty payments and production royalty rates that have been established by IDL and are set forth in the lease to be auctioned. Mineral Lease E310024 is for 20 years for the extraction of metallic minerals with a leased premises of approximately 294.25 acres on the following described parcels: Government Lots 1, 2, 3, 4, 5, 6, 7, 8, 11 and 12, SW1/4NW1/4, in Section 16, Township 48 North, Range 3 East, Boise Meridian, Shoshone County, Idaho. LEASE AUCTION TERMS AND CONDITIONS 1. The auction is for the leasehold interest only. 2. The annual rental rate, minimum annual royalty, and production royalty rates for the lease to be auctioned have been established by the Idaho Department of Lands ("IDL") as set forth in the lease. The minimum bid at the auction will be $295.00, and the minimum bid increment will be $1.00. The bidder submitting the highest bid at the auction ("Premium Bid"), as determined by IDL, will be awarded the lease. 3. No improvements exist in association with the lease. 4. All auction participants must register with IDL and complete all IDL registration forms and requirements prior to the registration deadline set forth above. No party will be permitted to register after the registration deadline. 5. Registration requires submitting the fully completed and executed forms to IDL at 300 N. 6th Street, Boise, Idaho; 3258 W. Industrial Loop, Coeur d'Alene, Idaho; 80 Hilltop Overpass Road, Kingston, Idaho; or via e-mail at MineralsLeasing@idl.idaho.gov by the registration deadline. The forms which must be submitted are the IDL Application for Use Form and the Statement of Non-Collusion Form (attesting that there has been no interference with anyone's right to bid in the bidding process), in addition to any applicable information set forth below. The required forms are available during the registration process at www.idl.idaho.gov/leasing/minerals-leasing. Registration also requires a $250.00 non-refundable application fee be paid to IDL by the registration deadline. Payments may be submitted to the IDL offices identified above or on-line at www.idl.idaho.gov/leasing/minerals-leasing. 6. Registrants that are legal entities must be authorized to do business in Idaho. Any entity required to file with the Idaho Secretary of State must submit a copy of its certificate of good standing with the Idaho Secretary of State to IDL prior to the registration deadline. 7. In order to be an eligible bidder, persons must be eighteen (18) years of age or older, of sound mind, and legally competent to contract for an interest in real property in the State of Idaho. No person or entity in default of any lease or other legal obligation to IDL is eligible to bid at auction. 8. Bidders must be the named applicant. a. Individual bidders may participate by agent or proxy on behalf of the applicant only with a fully executed power of attorney submitted and approved by IDL. The power of attorney must specify the authority granted to the agent/proxy (a limited power of attorney form for Idaho mineral leases is available at www.idl.idaho.gov/leasing/minerals-leasing), and must be submitted by the registration deadline and approved by IDL prior to the start of the auction. b. If the applicant is a legal entity, any person representing the legal entity must be identified as an authorized officer, general partner, member or manager of the entity (as applicable), or must otherwise be authorized in writing by a notarized resolution of the entity identifying and including the following: the full legal name and type of entity; contact information, address and phone number for entity; state of organization/origination; a statement that the entity is authorized to do business in Idaho; a statement that the identified person is fully and legally authorized to take all actions necessary on behalf of said entity to submit bids for State of Idaho Department of Lands mineral leases available for auction and to execute all leases won at auction on behalf of said entity; and, a statement attesting that all lawful and required actions by the entity have been taken to authorize said individual to act on the entity's behalf), which notarized resolution must be submitted by the registration deadline and approved by IDL prior to the start of the auction. 9. The successful bidder must submit the full amount of the non-refundable Premium Bid and the first year's rent to the IDL offices identified above in Section 5 or on-line at www.idl.idaho.gov/leasing/minerals-leasing by Tuesday, August 31, 2021, at 5:00PM (PDT). 10. If the successful bidder withdraws or refuses to accept or execute the lease, IDL will retain the Premium Bid, the first year's rent and the non-refundable application fee. IDL will then award the lease to the second highest bidder if there were only two bidders, or will reauction the lease if there were more than two bidders. 11. No assignment, sublease or other transfer of the lease will be allowed or approved from the date of the auction until possession under the lease, and thereafter only in accordance with the terms of the lease. 12. All bids are subject to acceptance by IDL at close of bidding. CITY OF MULLAN ORDINANCE NO. 395 AN ORDINANCE OF THE CITY OF MULLAN, STATE OF IDAHO, ESTABLISHING A SALARY FOR THE MAYOR AND CITY COUNCIL MEMBERS, REPEALING ANY CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MULLAN, COUNTY OF SHOSHONE, STATE OF IDAHO, AS FOLLOWS: Section 1:MAYOR COMPENSATION Commencing January 1, 2022, the annual salary of the Mayor shall be $2,400, payable in twelve (12) equal monthly installments of $200.00. Section2: CITY COUNCIL MEMBER COMPENSATION Commencing January 1, 2022, the annual salary of each Council Member shall be $1,200, payable in twelve (12) equal monthly installments of $100.00. Section 3:REPEAL OF CONFLICTING ORDINAN- CES. To the extent this ordinance conflicts with any other provisions of City Code, it is hereby repealed to the extent of such conflict. Section 4:SEVERABILITY. The provisions of this ordinance are declared to be severable. If any section, sentence, clause or phrase of the ordinance shall for any reason be held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this ordinance, but they shall remain in effect, it being the legislative intent that this ordinance shall remain in effect notwithstanding the invalidity of any part. Section 5:EFFECTIVE DATE This ordinance shall be effective upon its passage and a summary publication in the official newspaper of the City of Mullan, as provided for by law.
