NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS February 12, 2021 City of Wallace 703 Cedar Street Wallace, ID 83873 (208) 752-1147 On or about February 22, 2021, the City will submit a request to the Idaho Department of Commerce for the release of funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the City of Wallace Swimming Pool Renovation project, for the purpose of renovating the pool to include replacement of the entire pool floor and a 4-foot-wide section of the pool wall, new circulation piping and sealing, replacement of a small recycling tank, painting of the entire pool floor and walls, and replacement of gutter drains and recycling pipes. The project is estimated to cost $876,100, and is located at 604 Hotel Street, Wallace, Shoshone County, Idaho. The activity proposed is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Wallace City Hall, 703 Cedar Street, Wallace, Shoshone County, Idaho where the record is available for review and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M., Monday through Friday. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City's designated office responsible for receiving and responding to comments. All comments received by February 19, 2021 will be considered by the City prior to authorizing submission of a Request for Release of Funds. RELEASE OF FUNDS The City certifies to the Idaho Department of Commerce that the Honorable Lynn Mogensen in her capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Idaho Department of Commerce approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Idaho Department of Commerce will accept objections to its release of funds and the City's certification for a period of sixteen (16) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: a. The certification was not executed by the Certifying Officer of the City; b. The City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58. c. The grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Idaho Department of Commerce; or, d. Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
