Silverton man arrested for rape

Gordon Lewis Clemens was arrested on Wednesday and was charged with a single count of rape.

Clemens was arraigned on Thursday in Shoshone County Magistrate Court appearing before Judge Barbara Duggan via Zoom.

Clemens, 80, of Silverton was taken into custody at the Shoshone County Sheriff’s Office following an interview with the agency concerning an event that allegedly occurred on July 1 of this year according to court documents.

Rape is a broadly defined term in Idaho, but is listed as the penetration, however slight, of the oral, anal or vaginal opening with a penis — but also can include several other circumstances — which is the case in Clemens’ charges.

Clemens’ felony rape charge comes from Idaho statute I18-6101(3), which reads as follows:

Where the victim is incapable, through any unsoundness of mind, due to any cause including, but not limited to, mental illness, mental disability or developmental disability, whether temporary or permanent, of giving legal consent.

Rape is punishable by imprisonment in the state prison not less than one (1) year, and the imprisonment may be extended to life in the discretion of the District Judge, who shall pass sentence.

Bond was set at $30,000, and a no-contact order has been put in place.

Clemens is scheduled for a preliminary hearing on July 22.
