Kellogg woman convicted domestic battery

WALLACE – A Kellogg woman was found guilty of felony domestic battery earlier this week following a one-day jury trial that needed just 30 minutes to return a verdict.  

Destiny Morgan, 50, was arrested in the early morning hours of May 14, 2024, after law enforcement responded to a domestic call. 

According to court records, the incident began during the evening hours of May 13, when a reportedly highly intoxicated Morgan assaulted her victim after he returned home from work.  

According to the witness reports and law enforcement, Morgan first punched the victim in the face but then left the shared residence to cool off. When she returned, her behavior escalated and resulted in her threatening to kill the victim, throwing a heavy metal object at his head and then stabbing him in the arm with a fork.  

Kellogg Police Officer Dameon Groves responded to the call, but Morgan fled the home on foot and could not immediately be located. Eventually, law enforcement did locate her but after reportedly refusing to cooperate with police she was taken into custody and subsequently charged with domestic battery with traumatic injury.  

In June, Morgan pleaded not guilty to the charge, which set the table for Tuesday’s jury trial. 

According to court records, the defense’s argument hinged on Morgan’s assertion that her actions were motivated by her own fear of the victim but could not provide any evidence to corroborate her claim. 

Shoshone County Deputy Prosecutor Britney Jacobs, who tried the case on behalf of the State, stated that all the evidence suggested that Morgan’s actions were due to her high level of intoxication.  

Along with the standard presentence investigation, Morgan will also undergo a domestic violence evaluation. The results of both will play a part in her sentencing.  

The maximum penalty for felony domestic battery with traumatic injury is 10 years imprisonment and a maximum $10,000 fine.  

Morgan is scheduled for sentencing on March 10, at 10 a.m.
